On June 21, in volume 37 issue 24, Westlaw Journal Environmental published commentary from DeCotiis, Fitzpatrick, Cole & Giblin partner Michael J. Ash providing a comprehensive overview of recent decisions examining litigation in Pennsylvania and other jurisdictions in which property owners challenged the power of a regulated utility company to use eminent domain to acquire easements for pipeline projects.

His article examines the case law of eminent domain delegation generally, and includes a fact specific and legal analysis of noteworthy court decisions that review particular statutory schemes, drawing some conclusions about the reach of a private utility’s authority to exercise the fundamental governmental power of eminent domain to advance the public interest
